What happens when the employer receives a dilute specimen report?

As the employer, if the MRO informs you that a positive drug test was also reported as dilute, the employer simply treats the test as a verified positive test result. In this situation, the employer should never direct the employee to take another drug test based on the fact that the urine was reported as dilute.

As the employer, if the MRO informs you that a negative drug test was also dilute, the employer must take the following actions:

  • If the MRO directs the you…you must direct the employee to submit to a recollection under direct observation (i.e. because creatinine concentration of the specimen was equal to or greater than 2 mg/dL but less than or equal to 5 mg/dL).
  • If the creatinine concentration of the dilute specimen is greater than 5 mg/dL, the employer may, but is not required to, direct the employee to take another test immediately
  • Such recollections must be conducted under direct observation and you must treat all employees the same for this purpose.
  • You must ensure the employee is given the minimum possible advance notice that they must go for a recollection
  • The recollection test result must be treated as the test result of record and not the prior test
  • If the employee refuses to go for the recollection it is considered a refusal to test
